The Labour Party Defeats The APC In The Edo Senate Election Tribunal

 


In the lawsuit brought by the All Progressives Congress (APC) to challenge Senator Neda Imasuen's victory in the Edo South Senatorial elections, the Labour Party (LP) has prevailed.

Valentine Asuen, an APC candidate, reportedly went to the tribunal to contest the Independent National Electoral Commission's (INEC) certification that Imaseun had won the senatorial district election on February 25, 2023.

Matthew Iduoriyekemwen, a candidate for the Peoples Democratic Party (PDP), finished second, and Valentine Asuen finished third.

Asuen named INEC, the Labour Party (LP), and its candidate, Senator Neda Imasuen, as the first, second, and third respondents, respectively, in his lawsuit filed with the tribunal and designated EPT/ED/SEN/01/2023.

The lawsuit was dismissed on Tuesday by the Edo State Election Petitions Tribunal due to insufficient diligence in the prosecution.

The tribunal determined that Hon. Asuen and his party, the APC, entirely abandoned their petitions by filing a pre-hearing application on the second respondent out of time, according to a unanimous decision made by the tribunal's chairman, Justice Yusuf Ubale Mohammed.

The panel decided that the petitioners' behavior implied that they had given up on their claims, thus it was dismissed.

The petition was once again unanimously dismissed after the three-person panel determined that it was incompetent and had any validity. The panel also stated that the petition "has no leg to stand."

The panel had previously ruled that Senator Imasuen, the third respondent, was unable to testify against the petitioners since it was a pre-election matter that should have been brought before the Federal High Court.

An action brought by a non-member of the aforementioned party regarding the identity of a party candidate or the method of the party's primary election is not admissible, according to Justice Mohammed.

Regarding Neda Imasuen's supposed dual citizenship, the petitioners' failure to provide Imasuen's purported USA international passport and his Oath of Allegiance led the tribunal to conclude that the senator representing Edo South Senatorial District is a citizen of Nigeria.
