Donald Trump's Attorneys Create 'Stunning' Scheme To Avoid Gag Order

 

Before the former president's federal trial into alleged attempts to overturn the 2020 election results, Donald Trump's attorneys have made a "stunning" case for why a court shouldn't impose a gag order, according to a legal expert.

Lisa Rubin, an attorney and legal analyst for MSNBC, was talking about the recent 25-page filing made by Trump's attorneys rejecting Special Counsel Jack Smith's office's request for a limited gag order to be imposed to stop the former president's "near-daily" attacks on the case, prosecutors, and potential witnesses on social media, which could sway a jury.

Judge Tanya Chutkan, who is presiding over the case, has not yet determined whether to issue a gag order, which is frequently done in criminal prosecutions. She is among many who have come under fire from Trump's Truth Social tweets, which have called her out as "VERY BIASED & UNFAIR!" and demanded that she step down from the case.

In a series of tweets on X, formerly Twitter, Rubin claimed that Trump's attorneys have made a "doozy" case that the Biden administration is pushing for the gag order because it is "keenly aware that it is losing" the race for the GOP presidential nomination in 2024.

"Trump has submitted a response opposing Jack Smith's team's request to restrict what the president and his attorneys can say about witnesses and players in the federal election interference case. And it's a big one," wrote Rubin.

"Trump—despite the Justice Department and White House distancing themselves from any role in his case—now claims in 'the Biden Administration' charged him and now'seeks to unconstitutionally silence' him because it is 'keenly aware that it is losing that race for 2024.'

The Biden Administration has been accused of submitting the request, in their words, "to divert attention from Trump's 'commanding lead in the polls' and as a component of a larger election interference scheme," Rubin continued. that's one thing for Trump to say that, but it's astonishing to see it coming from his attorneys.

Email requests for comments have been sent to Trump's legal counsel.

 Trump has consistently denied any wrongdoing in connection with the efforts to rig the 2020 election and the attack on January 6, and he has entered a not guilty plea to the four federal counts that are the subject of Smith's investigation. The former president has also referred to the probe and other legal proceedings against him as "election interference" meant to prevent him from running for office again.

In addition, according to Trump and his attorneys, any attempt to enforce a gag order would go against his First Amendment right to free expression while he is running for president.

Following these attempts to undermine the president's defense, the prosecution is now asking the court to take the extraordinary step of denying the president his First Amendment rights during the crucial months of his campaign against Vice President Biden, according to the latest document from Trump's legal team. "The Court ought to reject this obvious game-playing and dismiss the request in its entirety.

The documents further state that "the proposed gag order is nothing more than a clear attempt by the Biden Administration to unlawfully silence its most prominent political opponent, who has now taken a commanding lead in the polls."

Trump's "disparaging and inflammatory" statements on Truth Social, according to federal prosecutors, could potentially taint a jury pool and jeopardize the case itself.
